Terms of Service

klusknit dotcom sdn bhd (klusknitdotcom) builds and owns technologies and services (the klusknit platform) that enable people to connect with each other, communicate and engage with each other on community building and create opportunities for local businesses to grow. These Terms of Service govern your use of the klusknit platform and the services therein.

The following terms of service (“Terms”) together with all associated klusknit dotcom sdn bhd services (“Services”), which shall be taken, construed and form part and integral part of the Terms, and together form a legally binding agreement (“Agreement”) between klusknit dotcom sdn bhd and yourself. The terms and conditions of the Agreement shall govern your usage of the klusknit platform. You must adhere to our Guidelines for Use, whether the existing terms or any amendments or modifications or update which may be made from time to time, when using klusknit platform and the services therein, and participating in any current, existing or future Products & Services.

Save and except for those expressly provided in Clause 5 of this Agreement, all data, information, text, links, graphics, photos, audio, videos, or other materials or arrangements of materials uploaded, downloaded or appearing on the Platform (collectively referred to as “Content”) are the property of klusknitdotcom. klusknitdotcom shall remain as the sole and absolute legal owner and/or beneficial proprietor of the intellectual property of the Content, including the copyright, trademark, confidentiality, legal rights, equitable rights, beneficial interest or other proprietary rights contained therein. You acknowledge that you shall acquire no right, title or interest in any intellectual property rights that is owned or licensed by us. You shall not attempt to decompile, translate, reverse engineer or make any copy of any Content.

As business conditions change, klusknitdotcom may modify or make changes to these Terms of Service, from time to time, and in its sole discretion by posting any such changes online (https://klusknit.com) or by notification to you on the klusknit platform. The revised Terms shall become effective as of the date it is uploaded on the website unless a different effective date is specified. If you do not agree to our updated Terms and no longer want to be a part of the klusknit community, you can terminate your account at any time.

1. Service Features on klusknit Platform

Our mission is to provide the requisite digital platform for people in neighbourhoods to come together and build their neighbourhood communities into thriving social groups, sparking better social cohesion, offering mutual help and improving all-round living environment.

i. Right Versus Privilege in klusknit community

Stronger ties make for better communities, and we believe our services are most useful when people are connected to people, groups, and organizations they care about.

Membership in a klusknit community is opened to every resident of a neighbourhood. It is a right to join as long as you are a verified resident of the neighbourhood and provided always that you agree to adhere to the terms and conditions of the Agreement. In certain social media platforms used by neighbourhood communities, membership is a privilege. A resident has to be admitted by the “admin” of the group to access membership. Yet, in certain other community platforms, membership is opened to anyone who is interested to join, regardless if he or she is a resident of the neighbourhood.

ii. Social Experience in a Safe Setting

As a user of klusknit, we strive to create a safe environment for you to connect and communicate with fellow residents. We verify a user who will then have full access to the klusnit services on the platform. More importantly, fellow users (residents) will and can engage with peace of mind knowing that every verified user is a bona-fide resident of the klusknit.

klusknitdotcom takes reasonable steps to maintain the security (including the availability, authenticity, integrity, and confidentiality) of our klusknit platform. Unfortunately, no data transmission of information over the Social Media can be completely secured. Accordingly, despite our best efforts to protect your Personal Data and information, we cannot guarantee, ensure or warrant the security of any Personal Data or information you transmit to us, or to or from our online products or services. All such transmission of information is carried out at your own risk.

We work with 3rd parties to develop tools and methodologies including to detect potential misuse of our platform, harmful conduct towards others, and situations where we may be able to help support or protect our community, including to respond to user reports of potentially violating content.

If we learn of content or conduct like this, we may take appropriate action based on our assessment that may include – notifying you, offering help, removing content, removing or restricting access to certain features, disabling an account, or contacting law enforcement. klusknitdotcom may access, preserve, use and share any information it collects about you where it has a good faith belief it is required or permitted by law to do so. We strongly advise users to be reasonable when sharing with fellow users in the klusknit. Untoward incidences arising from using this platform cannot be attributed to klusknitdotcom in any manner. Users will indemnify klusknitdotcom from any legal action arising from any use or misuse of klusknit platform.

iii. Rich and Relevant Services for Community Building

From the ability to create user groups within a klusknit- be it a smaller and more local resident grouping (sub-klusknit) or special interest groups (SIGs), the klusknit platform creates the opportunities for users to participate or undertake group activities. Platform services such as Alerts, Notifications, Discussions, Events, Favours, Shops will facilitate an enriched community spirit and comraderies. These services enable quick search or reference for users. In Discussions for example, we further help a user or users organize discussions or create action items to allow follow-up efficiently.

Other contents you see on our platform may include broad spectrum of advertisements and promotions which are relevant and potentially valuable to users. In certain instances, we allow users to rate and comment on advertised services providers to facilitate making good purchasing decisions. There are also opportunities for users to recommend good products and service providers (electricians, plumbers, renovators, etc) to the klusknit, perhaps further giving peace of mind to fellow residents.

We use data about the connections you make, the choices and settings you select, and what you share and do on and off our services – to personalize your experience.

iv. Subscription and Ad Free Use

klusknitdotcom is providing the services in the klusknit platform on a free to use basis. klusknitdotcom is also endeavoring to avoid third party advertisements being placed on the platform. This however, can be pursued to the extent that klusknitdotcom is able to secure financial support from users and supporters who are aligned with our objective and goal to provide a digital platform for neighbourhood residents to connect, interact and engage with one another. Further, our financial needs may be augmented with innovative businesses which klusknitdotcom can create through the platform once critical take-up is achieved.

2. Who May Use klusknit

You may use the klusknit platform and its attendant services only if you accept the Agreement with klusknit dotcom sdn bhd and are not a person barred from receiving services under the laws of Malaysia. In any case, you must be at least 18 years old to use the services. If you are accepting these Terms and using the services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to these Terms, in which case the words “you” and “your” as used in these Terms shall refer to such entity.

Our klusknit platform strives for transparency and openness to the extent possible and practical. A klusknit community or neighbourhood is meant to be a safe and secure environment for users or residents to engage with one another. This can only be achieved if you:
a. are truthful with the requisite information about yourself to become a member of a klusknit.
b. have only one account (which can have more than one klusknit if you qualify) and use it for personal purposes.
c. do not share your password, give access to your klusknit account to others, or transfer your account to anyone else (without our permission).

3. Privacy and Data Protection

Our Privacy Practice & Guidelines (“Privacy P&G”) explain how we treat your personal data.

Please take a moment to read our Privacy P&G before using klusknit services (“Portal”) or submitting any personal data or personal information to the Portal.
This Privacy P&G serves to inform you as user of this Portal that your personal data or personal information is being processed by us or on our behalf. By clicking “Accept”, you agree to and accept the terms and conditions as set out in this Agreement and the Privacy P&G, and hereby give your consent to the processing of your personal data or personal information (collectively refer to as “personal data”), including collecting, recording, holding or storing, using, disclosing and/or carrying out any operation or set of operations on your personal data. “Personal Data” refers to information that relates directly or indirectly to you, which can be used to identify you on its own or in combination with other data that we collect or have access to.

By using klusknit services, this Portal or by otherwise giving us your Personal Data, you are accepting the terms and conditions of this Privacy P&G. If you do not agree to this Privacy P&G, please do not use klusknit services, this Portal or otherwise give us any of your Personal Data.

Any Personal Data and information that you share with us will be processed, collected, used and stored for limited purposes, including:-

provide, maintain, protect and improve the Portal, to develop new services, and to protect ourselves and our users;
provide you with information of our products and also products from other members of klusknit services unless you have opted out from receiving such information;
manage your account and provide you with customer support;
develop and display content tailored to your interests on the Portal;
enforce any Terms and Conditions between us;
research purposes;
provide you with regular communications from us relating to the Portal.

We may share and disclose your Personal Data and information with:-

members of our group of companies for the purpose of developing new products, services or portals that are developed by our members;
service providers under contract who help with our business operations;
any person whom we have engaged to fulfill our obligations to you.

We may reserve the right to disclose your Personal Data or information, if required to do so by law, or in the good faith belief that such action is reasonably necessary to comply with legal process, respond to claims, or to protect the rights, property or safety of our company, our employees, customers, or the public.

By using klusknit services, you agree to our Privacy P&G and that we can use your information in accordance with our Privacy P&G. You recognize that personalization lies at the centre of some of our Services. By being a registered or verified user on the klusknit platform, you hereby agree and consent that we can show you ads that we determined to be relevant to you and your interests. We use your personal data to help analyse which personalized ads to show you. You hereby give your consent for your Personal Data to be used by us to advertise, promote or market our products or services. If you decide that you no longer wish to receive such communications, you can subsequently unsubscribe from receiving marketing-related communications at any time, by following the instructions provided in each such communication. To unsubscribe from marketing communications sent by any medium, including third party social networks, you can opt-out at any time by unsubscribing through links available in our communications. Please note that, even if you opt-out from receiving marketing communications, you will still receive administrative communications from us, and other important non marketing related announcements.

We do not sell your personal data to advertisers, and we do not share information that directly identifies you (such as your name, email address or other contact information) with advertisers unless you give us specific permission. We work with advertisers to determine the type of user groups that will be most appropriate for their advertising objectives. We may also provide advertisers with reports about the performance of their ads that help them understand how people are interacting with their content.

A link from this Portal to another portal does not imply endorsement of that portal. We do not control the portals to which we link and assume no responsibility for their content or privacy policies. Therefore, you should carefully review the privacy policy and the terms and conditions that apply to any portal you access from this Portal. This includes any company providing on-line payment via credit card or e-banking.

klusknit Privacy P&G detail how your personal data is collected and used. You can also go to your settings pages on the klusknit platform at any time to review the privacy choices you have about how we use your data. You understand that through your use of our Services, you agree and consent to the collection and use of this information, including the transfer of your Personal Data and information to other countries for storage, processing and use by klusknitdotcom.

4. Copyright or Other Intellectual Property Infringement Claims

We respect the intellectual property of others, and we expect our users to do the same. We may, in appropriate circumstances and at our discretion, disable, terminate, and/or take other appropriate steps relating to the accounts of users who may be infringers. If you believe that your copyright or intellectual property rights have been infringed, please contact klusknitdotcom immediately.

The klusknit brand and its logo may not be used by you in any manner to mislead or profit commercially. The brand and its logo are the sole property of klusknitdotcom sdn bhd and would require specific clearance and approval from klusknitdotcom for it its use by you.

5. Content in the Services and License Grant to klusknit dotcom sdn bhd

a. Content. Our services display some content that we did not create and do not own. This content is the sole responsibility of the entity or person that makes it available. We assume no responsibility for the conduct of third parties, including persons or entities with which you communicate using the services. Many of the services enable you to submit content. You – not klusknit dotcom sdn bhd – are entirely responsible for any content that you upload, post, email, transmit, or otherwise make available via the services. We may remove and refuse to display content that violates the Terms of Service or applicable laws or regulations, but that does not mean that we monitor the services or review or screen any content. By using or accessing the services you understand and agree that you may be exposed to offensive, indecent, or objectionable content.

b. IP Ownership and License Grant. Except as otherwise provided in the specific product terms or guidelines for one of our services, when you upload, share with or submit content to the Services you retain ownership of any intellectual property rights that you hold in that content. You undertake that your posting shall not violate or infringe the rights, including intellectual property rights, legal and equitable rights of others, and you shall irrevocably and unconditionally fully indemnify us and hold us harmless for all the postings made by you. In addition, you shall grant to us a worldwide, royalty-free, non-exclusive, perpetual, irrevocable, transferable, sublicensable license to (a) use, host, store, reproduce, modify, prepare derivative works (such as translations, adaptations, summaries or other changes), communicate, publish, publicly perform, publicly display, and distribute this content in any manner, mode of delivery or media now known or developed in the future; and (b) permit other users to access, reproduce, distribute, publicly display, prepare derivative works of, and publicly perform your content via the services, as may be permitted by the functionality of those services (e.g., for users to re-blog, re-post or download your content). In some of the Services, there may be specific terms or settings allowing a different scope of use of the content submitted in those services. You must have the necessary rights to grant us the license described in this Section 5(b) for any content that you upload, share with or submit to the services.

c. Content Management. You can delete individual content you share, post, and upload at any time. In addition, all content posted to your personal account will be deleted if you delete your account. Account deletion does not automatically delete content that you post as an admin of a page or content that you create collectively with other users, such as photos in Discussion Groups which may continue to be visible to other album members.
It may take up to 90 days to delete content after we begin the account deletion process or receive a content deletion request. While the deletion process for such content is being undertaken, the content is no longer visible to other users. After the content is deleted, it may take us up to another 90 days to remove it from backups and disaster recovery systems.

Content will not be deleted within 90 days of the account deletion or content deletion process beginning in the following situations:

where your content has been used by others in accordance with this license and they have not deleted it (in which case this license will continue to apply until that content is deleted);
where deletion within 90 days is not possible due to technical limitations of our systems, in which case, we will complete the deletion as soon as technically feasible; or
where immediate deletion would restrict our ability to:
investigate or identify illegal activity or violations of our terms and policies (for example, to identify or investigate misuse of our Products or systems);
protect the safety, integrity, and security of our Products, systems, services, our employees, and users, and to defend ourselves;
comply with legal obligations for the preservation of evidence, including Data Meta Companies providing financial products and services preserve to comply with any record keeping obligations required by law; or
comply with a request of a judicial or administrative authority, law enforcement or a government agency;

in which case, the content will be retained for no longer than is necessary for the purposes for which it has been retained (the exact duration will vary on a case-by-case basis). In each of the above cases, this license will continue until the content has been fully deleted.
d. Permission to use your name, profile picture, and information about your actions with ads and sponsored or commercial content. You give us permission to use your name and profile picture and information about actions you have taken on klusknit next to or in connection with ads, offers, and other sponsored or commercial content that we display across our platform, without any compensation to you.

e. Permission to update software you use or download. If you download or use our software, you give us permission to download and install updates to the software where available.

6. Using the Services on klusknit Platform

The klusknit platform is solely intended for users to engage and share contents that are important to them, but not at the expense of the safety and well-being of others or the integrity of the klusknit community. You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so):
i. You may not use klusknit platform to do or share anything:
a. that violates these Terms, the Community Guidelines, or other terms and policies that apply to your use of our Services.
b. that is unlawful, misleading, discriminatory or fraudulent (or assists someone else in using our platform services in such a way).
c. that you do not own or have the necessary rights to share.
d. that infringes or violates someone else’s rights, including their intellectual property rights (such as by infringing another’s copyright or trademark, or distributing or selling counterfeit or pirated goods), unless an exception or limitation applies under applicable law.

ii. You may not upload viruses or malicious code, use the services to send spam, or do anything else that could disable, overburden, interfere with, or impair the proper working, integrity, operation, or appearance of our systems Services.
iii. You may not access or collect data from our services using automated means (without our prior permission) or attempt to access data you do not have permission to access.
iv. You may not proxy, request, or collect usernames or passwords, or misappropriate access tokens.
v. You may not sell, license, or purchase any data obtained from us or our services.
vi. You may not misuse any reporting, flagging, dispute, or appeals channel, such as by making fraudulent, duplicative, or groundless reports or appeals.

We can remove or restrict access to content that is in violation of these provisions. We can also suspend or disable your account for conduct that violates these provisions.

If we remove content that you have shared in violation of the Community Guidelines, we’ll let you know and explain any options you have to request another review, unless you seriously or repeatedly violate these Terms or if doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our Services; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons.

To help support our community, we encourage you to report content or conduct that you believe violates your rights (including intellectual property rights) or our terms and policies, if this feature exists in your jurisdiction.

We also can remove or restrict access to content features, services, or information if we determine that doing so is reasonably necessary to avoid or mitigate misuse of our services or adverse legal or regulatory impacts to klusknit dotcom sdn bhd.

7. Modifying and Terminating the Services

a. We are constantly innovating, changing and improving the Services. Unless stated differently, we may, without notice, add or remove functionalities or features, create new limits to the services, or temporarily or permanently suspend or stop a service.
b. You can stop using the services at any time. You may cancel and delete your klusknit account at any time by clicking here. For more information, please visit the relevant Help Center.
c. We may temporarily or permanently suspend or terminate your account or impose limits on or restrict your access to parts or all of the Services at any time, without notice and for any reason, including, but not limited to, violation of these Terms, court order, or inactivity.
d. Subject to any statutory rights you might have, if your account is terminated, access to your username, password, and all related information, files, and content associated with your account may be terminated and your username may be recycled for use by others.

8. Account Suspension or Termination

klusknit is a place where people feel safe and welcome to express themselves and share their thoughts and ideas. If we determine, in our discretion, that you have clearly, seriously or repeatedly breached our Terms, including in particular the Community Guidelines, we may suspend or permanently disable your access to our Services, and we may permanently disable or delete your account. We may also disable or delete your account if you repeatedly infringe other people’s intellectual property rights or where we are required to do so for legal reasons.

We may disable or delete your account if after registration your account is not confirmed, your account is unused and remains inactive for an extended period of time, or if we detect someone may have used it without your permission and we are unable to confirm your ownership of the account.

Where we take such action we’ll let you know and explain any options you have to request a review, unless doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons.

If and when you are no longer a resident of a klusknit you are in, you are required to terminate your klusknit membership by informing klusknitdotcom via klusknit admin of your non-resident status. klusknitdotcom will then remove you from the klusknit by terminating your access. If in the event you are moving to another neighbourhood or klusknit, you will be requested to verify your address for the existing klusknit you are leaving from. Failure to verify will result in termination of your klusknit membership before your new klusknit membership is approved.

If you are a nominator, if you have reason to believe that your nominee is no longer a resident of the the klusknit which you have nominated him or her into, you are responsible to remove your said nominee from the klusknit. Failure to do so will result in violation of the Terms of Service.
If as a nominator, you no longer resides in the klusknit and has informed klusknitdotcom of your departure and eventual termination from the klusknit, your nominees will be required to verify themselves for continued membership to the klusknit.

This Agreement is terminated if you delete or we disable or delete your account. Notwithstanding the expiration or termination of this Agreement, certain terms and conditions in this Agreement shall survive the expiration or termination of this Agreement. For example, the ownership of the Content shall remain with klusknitdotcom. Similarly, our rights to claim for indemnity from you pursuant to clause 5(b) shall survive the expiration or termination of this Agreement.

9. Representations, Disclaimers and Limitations of Liability

a. Representations. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE, ALONG WITH OUR PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, PARTNERS, LICENSORS AND DISTRIBUTORS (COLLECTIVELY KLUSKNIT DOTCOM SDN BHD ENTITIES) DO NOT MAKE ANY REPRESENTATIONS, PROMISES, OR WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE SERVICES. WE PROVIDE OUR SERVICES “AS-IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE.” YOUR USE OF THE SERVICES, INCLUDING CONTENT WITHIN THE SERVICES, IS AT YOUR OWN RISK AND WE DO NOT REPRESENT, PROMISE, OR WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. YOU UNDERSTAND AND AGREE THAT NO DATA TRANSMISSION OVER THE INTERNET OR INFORMATION STORAGE TECHNOLOGY CAN BE GUARANTEED TO BE SECURE, AND WE EXPRESSLY DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, TO THAT EFFECT. WE MAKE NO COMMITMENTS, PROMISES OR WARRANTIES ABOUT THE CONTENT WITHIN THE SERVICES OR CONTENT LINKED FROM THE SERVICES, THE SUPPORT WE PROVIDE FOR THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES, THE SECURITY OF THE SERVICES, OR THE SERVICES’ RELIABILITY, QUALITY, ACCURACY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS, PROVIDE CERTAIN OUTPUTS OR ACHIEVE CERTAIN RESULTS.
b. Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE AND UNDERSTAND THAT KLUSKNIT DOTCOM SDN BHD ENTITIES WILL NOT BE LIABLE FOR: ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, TREBLE OR OTHER MULTIPLES OF DAMAGES, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICES. KLUSKNIT DOTCOM SDN BHD ENTITIES ARE NOT RESPONSIBLE FOR ANY LOST PROFITS, LOST REVENUES, LOST BUSINESS OPPORTUNITIES, DIMINUTION IN VALUE, INCLUDING ANY ALLEGED LOSS OR DIMINUTION IN VALUE OF PERSONAL INFORMATION, OR ANY OTHER LOSSES (COLLECTIVELY, “LOSSES”) ARISING FROM OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF OR ACCESS TO THE SERVICES, INCLUDING, BUT NOT LIMITED TO, LOSSES RESULTING FROM OR IN CONNECTION WITH: THE DELETION OF, ALTERATION OF, MIS-DELIVERY OF, OR FAILURE TO STORE DATA MAINTAINED OR TRANSMITTED BY THE SERVICES; THE LIMITING, SUSPENSION OR TERMINATION OF YOUR ACCOUNT; YOUR DOWNLOADING OR SHARING OF INFORMATION, INCLUDING PERSONAL INFORMATION, VIA THE SERVICES; THE UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR ANY DATA MAINTAINED OR TRANSMITTED BY THE SERVICES; LINKS PROVIDED BY THE SERVICES OR THIRD PARTIES TO EXTERNAL SITES OR RESOURCES; YOUR DEALINGS WITH OR PARTICIPATION IN PROMOTIONS OF ADVERTISERS FOUND ON OR THROUGH THE SERVICES; OR ANY GOOD OR SERVICES SOLD BY SUCH ADVERTISERS. KLUSKNIT DOTCOM SDN BHD ENTITIES WILL NOT BE LIABLE FOR PROBLEMS CAUSED BY OTHERS, THE WRONGFUL OR UNLAWFUL ACTIONS OF THIRD PARTIES, OR AN ACT OF GOD. THE LIMITATIONS AND EXCLUSIONS IN THESE TERMS WILL APPLY WHETHER OR NOT WE HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY LOSSES ARISING.

TO THE FULLEST EXTENT PERMITTED BY LAW AND EXCEPT AS OTHERWISE STATED, KLUSKNIT DOTCOM SDN BHD ENTITIES ARE NOT LIABLE IN CONNECTION WITH ANY DISPUTES THAT ARISE OUT OF OR RELATE TO THESE TERMS OR SERVICES FOR ANY AMOUNT GREATER THAN THE AMOUNT YOU PAID TO US FOR THE SERVICES.

Disputes
We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, it’s useful to know up front where it can be resolved and what laws will apply.
If you are a consumer, the laws of the country in which klusknit operates will apply to any claim, cause of action, or dispute you have against us that arises out of or relates to these Terms or the klusknit Services, and you may resolve your claim in any competent court in that country that has jurisdiction over the claim.

Feedback
You agree that any recommendation, idea, proposal, suggestion, feedback or other input (“Feedback”) you submit to us related to our products, services, websites, apps, or technology may be used by us without any notice, obligation, restriction, reimbursement or compensation to you and you waive (or agree not to enforce) any and all rights that may now or in future exist (including moral and equivalent rights) in any Feedback.

10. About these Terms
